GENERAL TERMS AND CONDITIONS OF SALE DOMETIC ITALY
1. Offers and orders
1.1. Dometic Italy offers are valid until the date specified in the same. Failing this, the end of the year on the date of issue of the offer is considered.
1.2. Orders must be transmitted only in writing and will be considered firm and irrevocable.
1.3. Orders received from customers cannot be cancelled or modified. If an order is cancelled or modified, the customer must reimburse Dometic Italy for the costs incurred up to the date of cancellation or modification, but not related to the cost of raw materials, logistics
and management of the order itself.
2. Delivery terms
2.1. Delivery terms are not binding on Dometic Italy. Dometic Italy is entitled to make partial deliveries, anticipate or postpone the delivery of all or part of the goods, without this constituting an entitlement for the Purchaser to request the total or partial termination of the order, or the recognition of compensation or indemnity. It is understood, however, that Dometic Italy will endeavour to ensure that the order is processed on the requested dates. Shipping terms are always quoted in our written order confirmation, except as
above.
2.2. In the event of a delay in delivery due to the Buyer's responsibility or the Buyer's refusal to accept a delivery, we reserve the right to store the goods in a risk-protected manner at the Buyer's expense. The delay or refusal of delivery by the Buyer does not change the
payment deadline for the goods shipped.
2.3. The Buyer is required to provide, during the Order phase, any useful information about special conditions existing at the delivery address (works in progress, road blocks, ZTL, areas subject to occupation of public land, narrow stairs, lack of lifts/goods lifts, etc.) in
order to allow the Dometic Italy courier to better organize the delivery. In this regard, it is specified that additional costs due to the lack of communication referred to in this paragraph at the time of the order will be borne by the Buyer.
3. Warranty, period and its commencement
3.1. The warranty is 2 years. For power generators, a maximum of 1000 working hours, always within the limit of 2 years.
3.2. The warranty starts from the date of the receipt or purchase invoice of the end user or from the date of registration of the vehicle in the case of original equipment products (on caravans, campers, boats, special vehicles, etc.). If the effective date defined above is
more than 6 months later than that of the Dometic Italy sales invoice, unless otherwise agreed in writing, the warranty will start from the date of the Dometic Italy invoice plus 6 months.
3.3. Warranty replacement of the product or a component does not extend the warranty period. In the event of a warranty replacement of the product or one of its components, a new warranty period does not start on the product or on the individual component supplied as a replacement, but the date of commencement of the warranty of the original good will always be taken into account.
4. Warranty, access and warranty recognition
4.1. At the sole discretion of the Dometic Italy service department, the warranty may be recognized in one of the following ways:
4.2. Repair of the defective product.
4.3. Replacement of the defective product with the same or equivalent model, new or secondhand.
4.4. Credit of the originally invoiced price.
4.5. Any return of a defective product, or presumed to be such, to Dometic Italy, can only be made if authorized in writing by the Dometic Italy service department. The return authorization form issued by Dometic Italy must be affixed to the package.
4.6. Unless otherwise agreed in writing, Dometic Italy will not reimburse costs relating to the dismantling and/or installation of defective, repaired or replaced products.
4. 7. To access the warranty, please contact Dometic Customer Service Italy on +39 0543 754 908 Monday to Friday from 8:00 am to 12:30 pm and from 2:00 pm to 5:30 pm, or by sending an email to assistenza@dometic.it. Requests for assistance must necessarily be
sent attaching:
4.7.1. Proof of purchase of the product (sales receipt or purchase invoice)
4.7.2. a brief but detailed description of the problem
4.7.3. photo/ identification label data of the affected item(s) or spare part(s).
4.8. For original equipment installed products, a document proving the date of registration of the vehicle must be shown.
5. The warranty is valid if:
5.1. The ordinary maintenance activities provided for in the user manual have been carried out regularly, aimed at avoiding damage over time.
5.2. The product has been installed correctly according to the assembly instructions, supplied with the product or available on the dometic.com website
6. The warranty will not be recognized if:
6.1. The routine maintenance required by the user manual has not been carried out.
6.2. You are unable to prove the date of purchase.
6.3. Serial numbers have been altered.
6.4. The product has been tampered with or has been used carelessly.
6.5. Damage has been caused by incorrect installation or caused by incorrect storage or storage during storage.
7. Unless otherwise agreed in writing:
7. 1. Warranty and service will only be provided at the offices of the authorized Service Providers (list on dometic.com) or at Dometic Italy S.r.l.
7.2. If, as a result of written agreements, on-site work is planned during the warranty period, no charge to Dometic Italy will be accepted unless previously authorized in writing by the Dometic Italy service department.
7.3. Requests for on-site interventions in the absence of the above-mentioned written agreements or outside the warranty period, must be verified in their feasibility with the service centers and the costs and payment methods of the intervention defined directly with the service centers themselves, outside the scope of the warranty.
8. Warranty, clarifications
8.1. The transport of products not under warranty is at the complete expense, risk and peril of the owner of the good.
8.2. The cost of consumables such as, for example, filters, oil, etc., remains the responsibility of the buyer.
8.3. If the product is not accessible due to other components or accessories that prevent access, warranty service will only be carried out after such obstacles have been removed and the costs have been authorized to be charged to the purchaser.
8.4. Dometic Italy S.r.l. does not provide "forklift" products to manage machine downtime during service periods, whether for warranty or out-of-warranty interventions.
8.5. In the event of a warranty replacement of the product or a component, the products or individual parts returned, upon replacement, become the property of the manufacturer.
9. Transport
9.1. Unless otherwise agreed in writing, shipments are made carriage collect with transport costs to be borne by the Buyer.
9.2. For shipments carriage free or free with charge, in the event of shortages or damage to the goods, the buyer must place a specific reservation only on the carrier's PDA and inform Dometic Italy in writing within 3 calendar days, sending a copy of the delivery note and
photographs documenting the damage.
9.3. In the case of hidden damage that is not evident at the time of delivery, inform Dometic Italy S.r.l. in writing within 7 calendar days of delivery, sending a copy of the DDT and photographs documenting the damage. Failure to place a specific reservation on the carrier's hand held device and failure to comply with the aforementioned deadlines will result in the forfeiture of the Purchaser's right to compensation from Dometic Italy.
9.4. For carriage forwards, in the event of shortages or transport damage, any requests for compensation must be addressed and defined directly with the courier who took care of the transport.
10. Goods return
10.1. Any return of goods, for any reason, will not be accepted and therefore rejected without the prior written authorization of Dometic Italy. The aforementioned return authorization form must be posted on the package.
11. Conformity of the product in relation to its intended use
11.1. By purchasing Dometic products, the purchaser declares that the Dometic products reflect and meet 100% the technical specifications requested by the purchaser, confirming that they are suitable for the intended use of the purchaser.
11.2. Dometic Italy is available to provide customers with all its technical know-how, before and after the purchase, to support customer satisfaction. Such availability is in no way to be understood as an assumption of responsibility by Dometic since, by using Dometic products, the purchaser confirms that he is responsible for the technical choices made and the owner of the project involving the use of Dometic products.
11.3. The customer undertakes to comply with the installation instructions in the product manuals. Dometic Italy shall not be liable for defects caused by installation or use not in accordance with what is specified in the product manual.
12. Responsibility
12.1. Dometic Italy shall not be liable under any circumstances for any consequential or indirect damages arising out of or in concession with the fulfilment of the order, including but not limited to loss of time, loss of profit, loss of interest or loss of production. The total amount of liability (compensable damages) and penalties payable by Dometic Italy may never exceed the total price of the order.
13. Prices. Payments. Interest on arrears
13. l. The prices applied to our products are those in force at the time of receipt of the order, unless otherwise agreed in writing.
13.2. Dometic Italy reserves the right to make changes to the list prices, without prior notice, if necessary. It is the customer's concern to request the updated version of the current price list.
13.3. Payments must be made in the established ways and times. Unless otherwise agreed in writing, the standard payment method is bank transfer in advance.
13.4. Failure to pay - even partial - on the agreed deadline will result in the automatic and immediate commencement of interest on late payments.
14. Proprietary rights relating to patents. trademarks
14.1. All property rights, including but not limited to patents, trademarks, know-how, copyrights, relating to the products as per catalogues, images, drawings, technical specifications and any other document made available to customers by Dometic Italy S.r.l.
including models, stamps and any other auxiliary tool used by Dometic Italy to define this contract, will always remain the sole property of Dometic Italy S.r.1. No licence or right is granted to Dometic S.r.1. customers in the form of patent, copyright, registered technical
drawing or intellectual property with the exception of the sole right to use and resell the products.
15. Reservation of title agreement
15.1. This sale is carried out with reservation of title (Art. 1523 of the Italian Civil Code and following) therefore the products remain the property of the Seller until full payment of the price by the Buyer. In the event of assignment of the credit or payment made by third
parties, the aforementioned retention of title will be considered transferred to them.
16. Buyer'sAttestations
16.1. Pursuant to Presidential Decree 633/72 art. 21 and 41/c, the Buyer confirms under his/her own responsibility the accuracy of the indication of the name, address and tax code and/ or VAT number.
17. Applicable law and Jurisdiction
17.1. Any dispute that may arise in relation to this contract shall be settled in accordance with
the laws of Italy. Jurisdiction Forli.
